These terms govern your use of the QuikAuthor web application, APIs, and related services (the "Services") provided by QuikAuthor ("we", "us", "our") at quikauthor.io. By using the Services, you agree to these Terms and Conditions.
1. Acceptance
By accessing or using the Services, you confirm that you agree to these Terms. If you do not agree, you must stop using the Services immediately. If you are using the Services on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.
2. Account and Eligibility
To access the Services, you must create an account. You must be at least 16 years of age. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Login credentials are personal and must not be shared.
QuikAuthor has two account types: Authors (who create and manage courses) and Learners (who are invited by Authors to complete training). Authors are responsible for the Learners they invite and must ensure they have a lawful basis for sharing Learner data with QuikAuthor.
3. Your Content and Data Responsibilities
You retain ownership of all content, data, and materials you upload or create using the Services ("Your Content"). By uploading Your Content, you grant QuikAuthor a non-exclusive, worldwide, royalty-free licence to store, process, and display Your Content solely as necessary to provide the Services. While we take reasonable steps to ensure availability and continuity, the Services depend on third-party infrastructure and we cannot guarantee uninterrupted access to Your Content at all times.
You are solely responsible for ensuring Your Content does not infringe third-party intellectual property rights, does not contain unlawful material, and complies with all applicable laws. You must not use the Services to store Protected Health Information (PHI) or payment cardholder data.
QuikAuthor uses the following third-party sub-processors to deliver the Services: Vercel (hosting), Supabase (database and authentication), Stripe (payments), Resend (email delivery), Google Gemini (AI processing), AssemblyAI (video transcription), ElevenLabs (text-to-speech), and Replicate (AI avatar generation). By using the Services, you acknowledge that Your Content may be processed by these sub-processors as part of delivering the Services.
QuikAuthor is not liable for any loss of Your Content resulting from your own misconfiguration or misuse of the Services. You should maintain your own backups of critical data.
4. Restrictions on Use
You must not sublicense, resell, or commercially exploit the Services without our prior written consent. You must not reverse engineer, decompile, or attempt to extract the source code of the Services. You must not use the Services to develop a competing product or conduct competitive analysis. You must not attempt to bypass any security controls or access the Services using invalid credentials. You must not upload any content that is unlawful, harmful, or contains malicious code.
5. Subscription, Payment, and Cancellation
Access to certain features requires a paid subscription. Fees are as displayed on our pricing page and are billed via Stripe. All fees are non-refundable and no credits will be issued upon cancellation. If you cancel your subscription, you may continue to use the Services until the end of your current paid billing period. Alternatively, you may request immediate termination in writing (by emailing info@quikauthor.io), in which case your access will end immediately with no refund or credit for the remaining period. We reserve the right to suspend or terminate your account for non-payment.
6. Termination
Either party may terminate this Agreement at any time. We reserve the right to terminate your account immediately if you breach these Terms. On termination, your access to the Services will cease and your data may be deleted in accordance with our retention policy set out in the Privacy Policy.
7. Disclaimer and Limitation of Liability
The Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.
To the maximum extent permitted by applicable law, QuikAuthor's aggregate liability for any claims arising from or related to these Terms shall not exceed the total fees paid by you to QuikAuthor in the twelve months preceding the claim. We are not liable for any indirect, consequential, incidental, or special damages including loss of data, revenue, or business.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
8. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform. Your continued use of the Services after the effective date of any change constitutes acceptance of the updated Terms.
